If you are injured at work your employer is liable to pay you compensation or damages.

What compensation can I claim?

For less serious injuries and injuries that occur in circumstances where there is no negligence on the part of your employer, Workers Compensation Benefits are available for:

  • Wages at a rate limited by the Workers Compensation Act.
  • Medical expenses.
  • Lump Sum Compensation for Permanent Impairment.
  • Domestic Assistance.

If your injury is serious and occurs as a result of the failure of your employer to take reasonable care for your safety, you may be able to claim Work Injury Damages and be more fully compensated for your actual wage loss.

When can I claim?

Workers Compensation Claim forms must be lodged within 6 months of your injury.

Claims for Work Injury Damages must be commenced within 3 years of your injury.

Who pays the claim?

Your employer has a Policy of Insurance that covers injuries sustained by you at work.

What costs do I have to pay?

We will cover the costs associated with the processing of your workers compensation claim such as costs associated with obtaining medical reports. The Insurer pays us for assisting you with your claim. You are not liable for any costs at all in relation to your workers compensation matter.

If you are entitled to make a Work Injury Damages Claim, the Insurer is obliged to pay some but not all of your legal costs in addition to paying Damages for your loss of wages.
